I've just heard that Apple's being sued in advance because the iPods might make us feeble humans deaf. Furthermore, Apple's being accused of not stressing these possible dangers enough in the owner's manual. Further furthermore, looking back at the history of such cases, it is very likely for the plaintiffs to get through with it.

Then there's still this whole jury-thing, meaning inexperienced civilians get to judge over the accused.

And -- I know you've all been waiting for this -- on top of it all: Death Sentence (Can I get a "duh~duh~duuuh" for this?)

I'm sure that you can find a lot of other examples if you just dig deep enough, but before I do that, I'd like to hear some of your opinions regarding the American law-system. In fact, I only brought this topic up because someone one this forum recently said that it was probably the best existing law-system worldwide - so maybe now you're able to understand why that Apple-case made me smirk.

Discuss. Bitch about it. Call me a dimwit or just prove that maybe I should do the research before posting such topics.

I'll sue you all if you don't.

Headphones or output, if the sound was considered loud there could have been some testing done on that, which they are now doing. Maybe also to rule a standard as to which volume of sounds are safe to hear for most people.

I am not sure whether those people are fans of listening to the loudest possible volume of any player and this one just happened to deliver that louder volume, or if they did listen at a normal volume rate. Loud Sounds can appear to be quiet due to the frequency in relation to sounds that are not normally heard.

For those who own an Ipods: On yours is it easy to go up to 115 decibels without appearing to sound loud?

Was it in the best interest to market products so quickly, so defects in the quality like the plastic goes out until noticed.

It's rather sickening when people take advantage of dumb judges, juries, and the law system in general. Like that classic case of McDonalds coffee burning that woman because she spilled it on herself and willing a law suit.

Only in America can you sue someone for your own stupidity and win. I think I've said that before.

I usually hear the term "Someone can sue over cold water."
Hearing cases like these, is turning out to be true.

Appears that they are trying to prioritize on blame and not solutions.
Could this be a way to direct attention to petty cases, rather than cases with importance?

How would that sound for IBM?
Actually business may sound better.

Or "Look! Our chips are decorative, give us more interest?"

People listen to Ipods for longer periods of time than any other portable music player. They also come equiped with ear buds, which place the sounds source closer to your ear drum.

They are dangerous.

On top of which they only last about 2 years, which makes them the worst. My discman has lasted me 8 years.

I get freaked out having headphones on when I run. I'm really cautious about my hearing and vision. I'd like to keep that stuff in good working order until I die - whenever that is. So I run with the volume almost all the way down - and its still friking loud.

I dont like Ipods cause you cant put the songs in the exact order you want to listen to like you can when you burn a cd. And I like that my portable cd player costs a fraction of the price.

If people check around they WILL see that Micro-soft is a lesser of 4 evils. Nintendo, Linux and Apple are all evil...

Micro-soft: We will intentionaly sell you faulty protucts with many bugs just so you can buy the upgrades that really dont do shit.

Nintendo: We dont have upgrades, so everytime you want the latest stuff your gonna have to buy the NEW product.

Linux: We were founded by a mad Soviet Scientist bent on taking over the internet market.

Apple: We have crappy interface and make upgrades every 3 years, but people buy us becouse we say that Micro-soft is evil and people are idiots and believe us.

If kitchen knives are dangerous doing the only thing they are designed to do, you have a point. I know fuck all about this case, but if it can be shown that iPods can cause permanent hearing loss while causing no pain or discomfort during use (that is, damage without warning), then they are dangerous while doing the only thing they are designed to do. That's someone's fault, and I dare say the law won't say it's the user.

I agree that people shouldn't just keep suing one another all the time without cause, but there is a limit even to that sort of reasoning. The mechanism of civil suits is in place to prevent people from seeking reparations for damages by illegal means.

Anyway, this all reminds me of the scare where cell phones were going to give us brain tumors.

Cobnat: Not having upgrades for a system does not make the company that builds it evil. When you become the electrical engineer that builds very different software platforms, you're probably going to be pissed if your boss says that it also needs to work with old stuff of a different type. Then you can complain.

Now, if you'd said something that was a legitimate complaint, like Nintendo owning exclusive rights to the entire process of emulation, thereby making all roms illegal, even for the really old games that you can't find anymore, then I'd agree with you. They're jackasses.

And that Linux statement has to be a joke. tongue.gif "Oh noes! The Internet market is hax0red by free stuff!"
